1. Definitions

  • Museo — the mobile application and digital platform operated by MUSEO Sp. z o.o.
  • User — any person accessing or using the Museo application or services.
  • Ambassador / Volunteer — a User contributing content to Museo, including images, metadata, or descriptions.
  • User Content — any content uploaded or submitted by Users, including photographs, images, text, metadata, audio, or other materials.
  • AI-Generated Content — descriptions, audio guides, translations, or other materials created or enhanced using artificial intelligence systems.
  • Service — all features and functionalities provided through the Museo application.

2. Acceptance of Terms

By accessing, registering for, downloading, or using Museo, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you must immediately cease using the application.

3. Eligibility

You must be at least 16 years of age to use Museo. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18 years of age, you confirm that you have obtained consent from your parent or legal guardian.

4. User Accounts

  1. Users may create an account to access additional features of the Service.
  2. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  3. Users may delete their accounts at any time through the application settings or by contacting contact@themuseo.ai.
  4. Account deletion does not automatically delete User Content previously submitted under the license granted in Section 5.
  5. Museo reserves the right to suspend or terminate accounts that violate these Terms.

5. User Content & License Grant

By uploading, submitting, or otherwise making available any User Content, you grant MUSEO Sp. z o.o. a:

worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable, and transferable license

to use, store, reproduce, modify, adapt, publish, translate, display publicly, distribute, and create derivative works from such User Content for:

  • providing and improving the Service,
  • AI processing, machine learning, and model training,
  • analytics, research, and archival purposes,
  • marketing and promotional activities.

Important:

  • This license survives account deletion and cannot be revoked.
  • Museo is not obligated to provide attribution or compensation for User Content.
  • Museo is not obligated to remove User Content upon request unless legally required to do so.

6. Ambassador & Volunteer Contributions

Ambassadors and Volunteers acknowledge and agree that:

  1. All contributions are voluntary and provided without compensation.
  2. Uploaded content may be reused indefinitely under the license terms in Section 5.
  3. Museo may refuse removal requests at its discretion.
  4. Museo may modify, edit, or adapt contributed content.

7. Content Moderation & Reporting

Digital Services Act (DSA) Compliance

7.1 Content Standards

Users must not upload content that:

  • is illegal under EU or Polish law,
  • infringes intellectual property rights,
  • contains hate speech, harassment, threats, or discriminatory material,
  • violates the privacy or rights of others,
  • is misleading, fraudulent, or deceptive.

7.2 Reporting Illegal Content

Users may report content by emailing contact@themuseo.ai with subject line "Content Report". Reports must include:

  1. Clear identification of the content,
  2. Explanation of why the content is believed to be illegal,
  3. Contact information of the reporter.

7.3 Moderation & Appeals

Museo will review reports within 14 days. Users may appeal decisions within 14 days of notification by emailing with subject line "Content Appeal". Appeals are reviewed within 30 days and the decision is final.

8. AI-Generated Content

EU AI Act Compliance

  1. Museo uses artificial intelligence systems to generate and enhance descriptions, audio guides, translations, image recognition, and other content.
  2. AI-Generated Content is clearly labeled within the application where technically feasible.
  3. When interacting with AI-powered features, you are informed that you are interacting with an AI system.
  4. Museo does not guarantee the factual accuracy, completeness, or reliability of AI-Generated Content.
  5. Users should independently verify information where accuracy is critical (e.g., historical facts, artwork attribution).
  6. User Content may be processed by AI systems for the purposes described in Section 5.

9. Prohibited Uses

Users shall not:

  • Use the Service for any unlawful purpose or in violation of applicable laws.
  • Upload malicious software, viruses, spam, or unauthorized automated systems.
  • Attempt to circumvent security measures or access restricted areas.
  • Scrape, harvest, or collect data from the Service without authorization.
  • Impersonate others or provide false information.
  • Use the Service to harass, abuse, or harm others.
  • Reverse engineer, decompile, or disassemble the application.

10. Payments & Subscriptions

  1. If paid features are offered, payments are processed by third-party providers (Apple App Store, Google Play Store, Stripe).
  2. Subscription terms, automatic renewal, and cancellation are governed by the respective platform's policies.
  3. Refunds are subject to applicable platform rules and consumer protection laws.
  4. EU consumers have a 14-day withdrawal right for digital content purchases, unless the service has been fully performed with your express prior consent.
  5. Prices include applicable VAT unless otherwise stated.

11. Intellectual Property

The Museo application, including its design, source code, trademarks, logos, and original content (excluding User Content), is the exclusive property of MUSEO Sp. z o.o. and is protected by Polish and international intellectual property laws. Users may not copy, modify, distribute, sell, or create derivative works of any part of the Service without express written permission.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  1. Museo is provided "as is" and "as available" without warranties of any kind.
  2. MUSEO Sp. z o.o. is not liable for: inaccuracies in content, service interruptions, third-party claims related to User Content, or actions of third-party service providers.
  3. Total liability shall not exceed the greater of: (a) the amount paid by the User in the 12 months preceding the claim, or (b) €100.

Note: These limitations do not affect mandatory consumer rights under EU law, including rights under the Consumer Rights Directive.

13. Indemnification

You agree to indemnify, defend, and hold harmless MUSEO Sp. z o.o., its officers, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from: your violation of these Terms, your User Content, or your violation of any third-party rights.

14. Changes to Terms

Museo may update these Terms at any time. Material changes will be communicated via in-app notification, email to registered users, or notice on our website. Changes take effect 30 days after notification unless a longer period is required by law. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law & Dispute Resolution

  1. These Terms are governed by the laws of Poland and applicable European Union regulations.
  2. EU consumers may bring claims in the courts of their country of residence.
  3. For out-of-court dispute resolution, EU consumers may use the European Online Dispute Resolution platform: https://ec.europa.eu/odr
  4. Any disputes not resolved amicably shall be submitted to the competent courts in Warsaw, Poland.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
